I’m not a legal expert, but I think I know why we have laws. A code of laws helps out sort out our disagreements and constructs a range of consequences for agreed on unacceptable behavior.
The law shouldn’t stratify people as above or below other people. It shouldn’t give a democratically elected official a free pass to abduct and torture. We didn’t agree on that. But alas, this is how the legal system is being subverted right now. If a government official claims immunity from laws and is not subject to private arbitration, what recourse does a violated individual have? What can possibly limit the government official’s power?
American officials kidnap and torture under the guise of national security. The Rendition program has been thoroughly documented, with testimony from people who have been innocently rendered to Syria. Why do American officials refuse to acknowledge their wrongdoing? It’s because they don’t want to be accountable for their actions. Until we agree and pass a law that grants the extraordinary ability to use that amount of force on a suspect, they have no right to do so.
Let me remind you that Hitler was democratically elected. Democracies have the potential to produce criminals. Please remember that.
